1. General provisions

1.1. This Policy for the use of the site (hereinafter - the Policy) regulates the legal relationship between the administration of the Institute for Economics and Forecasting of the National Academy of Sciences of Ukraine (hereinafter - the Administration) and a natural person (hereinafter - the User) when using the interactive resources of the site, as well as when posting text messages, videos, audio, graphics contents (hereinafter referred to as Contents) on the website at https://ief.org.ua (hereinafter referred to as the Site). A user is a natural person who has registered on the Site and uses the services of the Site. The text of this Policy is displayed to the User upon registration. The policy takes effect from the moment the User agrees to its terms by registering on the Site. The User can use the services of the Site only after registration.

1.2. This Policy may be changed by the Administration without any special notification to the User. The new version of the Policy becomes effective from the moment it is posted on the Site.

1.3. Legal relations arising between the User and the Administration in connection with the observance of this Policy are regulated by the legislation of Ukraine.

2. Interaction

2.1. The Site provides the Users with online services (hereinafter referred to as the Service), which include:

• coverage of the Institute's activities (the Site’s actual content https://ief.org.ua is available without registration);
• the means of the Users’ posting of their Contents, which are obtained as a result of the performance by the Institute’s employees of their functional duties in accordance with the job instructions;
• means of registration, password recovery and feedback.

2.2. In order to use the functions and Services of the Site, the User must go through the following registration procedure:

• fill out the registration form
• agree to the terms of this Policy
• agree to the terms of the Privacy Policy. At the same time, the Administration checks the information provided by the User for the veracity and compliance with the information provided to the Personnel Department of the Institute
• upon completion of the registration process, the User enters the account login and password to access the Site’s Services. The User is personally responsible for the security of his login and password, and bears full responsibility for all actions that he will perform while using the services of the Site under the entered login and password
• the User agrees that the Administration has the right to collect and store the User's registration data (if received) within the Service for the purpose of fulfilling the provisions of this Policy

2.3. All issues of granting access rights to the Internet, purchasing and installing the appropriate hardware and software are carried out by the User independently and are not covered by this Policy.

2.4. The User's password for working with the Site's services can be restored by the Administration only in case of the provision of accurate, correct and complete information, specified during the initial registration of the account by the User or when the User is identified by the Personnel Department of the Institute.

2.5. Posting Contents and using the Site’s Services are carried out only by responsible persons appointed by the Institute’s order, and only to the extent provided for by the respective role of the User. Posting Contents, other than personal data, is only allowed with the written permission of the Director of the Institute, or his Deputy responsible for the relevant area, or the Institute’s Scientific Secretary. Posting Contents and using the Site’s Services on behalf of other Users is prohibited.

2.6. If Contents are displayed illegally or violates the rules of use of the Site and/or is such and/or contains information that contradicts the requirements of current legislation, it is subject to removal.

3. Posting Contents on the Site

3.1. The User provides his Contents for publication on the Site, and also transfers to the Administration the exclusive right to provide wide access to the Contents within this resource without any remuneration.

3.2. The User agrees that the Administration has the right to post advertising banners and announcements on the pages containing the User's Contents, and to modify the Contents for the purpose of posting advertisements.

3.3. Responsibility for unauthorized copying and use of materials is borne by all and any legal entities and individuals who illegally use Contents posted on the Site.

3.4. Until otherwise established, all property and personal non-property rights to the Contents belong to the Administration. The user is warned about the responsibility established by the current legislation of Ukraine for illegal use and placement of other people's materials (works). If it is established that the User who posted the Materials is not their legal right holder, these Materials will be removed from free access at the first request of the legal right holder.

3.5. Contents posted on the Site must not contain elements that:

• are illegal, harmful, threatening, that offend morality, honor and dignity, the rights and interests of third parties protected by law, defamatory, that violate copyright, promote hatred and/or discriminate against people based on race, ethnicity, sexual, or social features, that contribute to the incitement of religious, racial or ethnic enmity, contain scenes of violence, or inhumane treatment of animals, etc., established by the Constitution of Ukraine, the Law of Ukraine "On the Protection of Public Morals" and other relevant regulatory legal acts
• violate minority rights
• present oneself as another person or a representative of an organization and/or society without sufficient rights, including the Institute’s employee and member of the Administration, as well as misleading about the properties and characteristics of any subjects or objects
• the User does not have the right to make available according to the law or according to any contractual relationship
• violate the rights of any patent, trademark, trade secret, copyright or other property rights and/or copyright and related rights of third parties
• include computer codes designed to disrupt, destroy or limit the functionality of any computer or telecommunications equipment or programs, to carry out unauthorized access, as well as serial numbers to commercial software products, logins, passwords and other means for obtaining unauthorized access to paid resources on the Internet
• intentionally and/or accidentally violate any applicable local, state or international laws
• collect and/or store personal data of other Users
• include unauthorized transfer of records of advertising, commercial or campaigning nature
• drug advertising;
• posts containing rude and offensive expressions and suggestions
• posts containing pornography
• information that is illegal, unreliable, inadequate or incomplete.

3.6. The user understands and agrees that the responsibility for all information, data, text, programs, music, sounds, photos, graphics, videos, messages and other materials posted for public access or transferred privately lies with the user and the responsible person, which granted permission for this placement.

3.7. The User may not transmit Contents for posting if they are not created personally by the User or for whose posting the User does not have the permission from the Administration.

3.8. In case of receiving complaints from third parties related to posting of materials by the User, the User shall independently and at his own expense settle such complains.

3.9. The head of the Institute is responsible for the legality, reliability, adequacy and completeness of the information posted on the website.

4. Removal of User’s Contents

4.1. The User agrees that the Administration reserves the right to terminate the User's account and/or block the User's access to the Site at any time without prior notice to the User and without specifying the reason in the following cases:

• violation of the provisions of this Policy, its parts and appendices
• at the relevant request of state authorities, in accordance with current legislation
• transfer by the User of his login and password with defined access rights to another person
• in other cases, if the Administration considers such removal necessary for the normal operation of the Site

4.2. The User has the right to refuse to use his account on the Site at any time. In this case, the Administration removes the User's account on all Services on the Site. Materials posted by the User on the Services in such cases may either be destroyed without the possibility of restoration automatically, or may remain on the Site with the permission of the Administration.

4.3. Termination of the User's account involves:

• removal of the User's access to the personal part of all services of the Site
• removal of the User's login and password and his personal data

4.4. The Administration reserves the right to change (moderate) or delete any information provided by the User, including information (contents) that violates the prohibitions set forth in Clause 3.5. of this Policy (as well as any other prohibitions and requirements stipulated by the current legislation of Ukraine), including personal messages and comments, with or without prior notice, and not be responsible for any damage that may be caused to the User by such actions.

4.5. In the event that the User posts Contents that do not belong to him and receives a reasoned complaint from the right holder about the violation of his rights protected by law, the Administration has the right to remove the Contents posted by the User or block access to it for Users without notifying the User and without explaining the reasons.

5. Rights and obligations

5.1. The Administration tries to ensure uninterrupted operation of the Site, but is not responsible for the complete or partial loss of Contents posted by the User, as well as for insufficient quality or speed of the Service.

5.2. The User has the right to provide for posting on the Site objects of intellectual property, the right to whose use belongs to him on legal grounds.

5.3. The Administration has the right to refuse the User to post Contents, text messages, as well as to remove Contents Materials at their discretion, if their content contradicts the requirements of this Policy.

5.4. The User agrees that he is fully responsible for the Contents posted by him on the Site. The Administration is responsible for their compliance with the requirements of the law, for copyright infringement, unauthorized use of signs for goods and services (trademarks), brand names and their logos, as well as for possible violations of the rights of third parties in connection with the posting of Contents on the site. In case of receipt of complains from third parties related to the posting of Contents, the User must independently and at his own expense settle such complains.

5.5. The User grants the Administration a non-exclusive license to use, including reproduction, distribution, processing, public display and making public the Contents provided by the User for public viewing as Site content. The user, who is the legal Author of the materials specified in this paragraph, retains all property and personal non-property copyrights, in accordance with the legislation of Ukraine and international agreements.

5.6. The user agrees not to reproduce, repeat or copy, sell or resell, and also not to use for any commercial purposes any objects of intellectual property posted on the Site, except when such right is granted to him by the legal rights holders.

5.7. The Administration does not guarantee that the Site's services will meet the User's requirements; will be provided continuously, quickly, reliably and without errors, and the results that may be obtained by the User will be accurate and reliable.

5.8. Any Contents obtained from the Site are used by the User at his own peril and risk. The User is solely responsible for any damage that may be caused to his computer and/or data as a result of downloading and using these Contents.

5.9. The Administration undertakes to notify the User of third-party complains as to the User's posting of Contents. The User undertakes to either grant the Administration the right to publish the Contents or remove the Contents.

5.10. The Administration has the right, at the first request from the relevant authorized (law enforcement) agency (in accordance with the current legislation), to provide such state agency with available information about the User.

5.11. The User acknowledges that the Administration may set restrictions on the use of the Site's Services.

5.12. If a person is found to be carrying out actions that qualify as spam (i.e. posting Contents that do not correspond to the Site's topic) or flood (i.e., posting information that does not make sense) on the Site, the Administration has the right to block such a person from using the Site's Services. In addition, the Administration has the right to apply to law enforcement agencies for prosecution for such actions.

5.13. The Administration bears no responsibility for:

• the User's actions on the Site
• failures occurring in telecommunications and/or energy networks, actions of malicious programs, as well as for unscrupulous actions of third parties
• or any damage to the User's software and/or hardware that occurred as a result of using the Site

6. General information

6.1. This Policy is a legal obligation for both the Administration and the User.

6.2. The User has the right to refuse to accept changes and additions to the Policy prepared by the Administration, which means the User's refusal to use the Site's Services.

6.3. All possible disputes arising on the occasion of or in connection with the implementation of this Policy are to be resolved in accordance with the provisions of the current legislation of Ukraine.

6.4. Any item in the Procedure cannot be understood as the emergence of agency relations, cooperation relations, joint activity relations, personal employment relations, or any other legal relations not expressly provided for in this Policy between the User and the Administration.

6.5. The User who believes that his rights and interests have been violated due to the actions of the Administration or third parties in connection with the posting of any Content on the Site, sends a claim to the support service (ieprnanu@gmail.com). The Content will be immediately removed from free access at the first request of the rightful owner.

6.6. In the event of the adoption of regulatory legal acts by the state authorities of Ukraine, which relate in whole or in part to the functioning of the Site or Services, the Administration reserves the right to make any changes in the functioning of the Services, aimed at bringing the Site's activities into compliance with the new regulations.
